As promised, Congresswoman Nicole Malliotakis has filed an appeal of the highly irregular and clearly political decision by a Manhattan Supreme Court judge to rule her seat unconstitutional. The judge, a former counsel and chief of staff to Hochul, determined that the 11th Congressional District drawn and passed by the Democratic Legislature and signed into law by the governor was improper. If this were to happen, it would be the fourth time New York’s congressional districts would have been redrawn since the last census in 2020.
In practice, this would result in the drawing of new maps by the Independent Redistricting Commission, affecting the entire state, with congressional petitioning set to begin on February 24.
Hochul and the Democrats in the Legislature earned themselves the hypocrites of the decade award by praising the decision overturning lines they themselves had created and made law.
As of this writing, the Independent Redistricting Commission has taken no action to redraw any lines. Legal experts anticipate a stay, with petitioning on the existing lines beginning on time.
Malliotakis has indicated that if the state provides no relief, she will go to the U.S. Supreme Court.
