Description of Assembly Bills used in Ratings # 1. S.3178 Robach - A. 6222 Abbate This bill seeks to provide for a continuing penalty on an employer that fails to bargain in good faith and for mitigation of penalties against employees who violate no-strike provisions while an employer is not bargaining in good faith. The Conservative Party, along with many editorial boards across the state, opposes this bill on the belief that any public union subject to the Taylor Law can state that the employer is not “bargaining in good faith” to allow PERB to expedite decisions. It would also give PERB the authority to force employers to increase salaries. #2. S. 4331 Hannon – A. 8105 Eddington The Conservative Party supports this bill that conforms the schedules of controlled substances with federal law. # 3. S. 6397 Farley – A. 9722 Abbate The Conservative Party opposes this bill that seeks to prohibit the diminution of health insurance benefits of public employee retirees. The Conservative Party believes, especially with ever increasing health care cost for retirees, that the state and local governments should have the ability to manage their health-care programs. #4 S. 6409 Skelso – A. 9472 Aubry This bill requires level one sex offenders to register for 20 years and level 2 sex offenders to register for life. The Conservative Party strongly supports the civil confinement of sex offenders, and believes this legislation is a good step in the right direction to eventually achieve civil confinement. #5 S. 6441 Spano – A. 9691 John This bill requires certain employers to develop and implement programs to prevent workplace violence. The Conservative Party abhors violence in the workplace, home or on our streets, however, no program developed by employers will ever be able to fully prevent violence and it will ultimately place a further burden on employers and increase the cost of doing business while not being able to achieve its goal. #6 S. 6451 – A. 9551 Budget Bill The Conservative Party continues to oppose the Legislative and Judiciary Budget and all of the member items contained within it. #7 S. 6457 – A. 9557 Budget Bill The Conservative Party continues to oppose the Health and Mental Health Budget which allows tax payer funding of abortions. #8 S. 6758 Spano – A. 10060 Espaillat This bill seeks to add 52,000 day care providers to the state payroll. The bill, heavily supported by organized labor, would actually drive up the cost of day care or force day care providers to lay off employees due to increased costs, ultimately hurting the very families dependent on day care. The Conservative Party and again editorial boards across New York State are opposed to this bill. #9 S. 7193 Rules – A 10569 Rules The Conservative Party always supports bill that seek to decrease taxes paid and this bill relates to the election of a city or count to exempt clothing and footwear from sales and compensating use taxes. #10 S. 7568 Nozzolio – A. 10859 Magee This bill seeks to enforce the collection of taxes on the sales of tobacco products to non-Indians at Indian owned businesses by prohibiting tobacco manufactures from selling these products to stamping agents who in turn are selling untaxed cigarettes t these business in violation of our current law. Current statutes mandate the collection of the sales and excise taxes on those sales of tobacco products to non-Indians at Indian owned businesses, the Conservative Party supports the intent of the current statute. #11 S. 8174 Bruno – A. 11804 Rules The Conservative Party always supports bill that seek to decrease taxes paid and this bill provides a personal income tax credit for school district property taxes. #12 S. 8287 DeFrancisco – A. 10721 Zebrowski This bill makes changes to the Estates, Powers and Trusts Law in order to protect a child in gestation at the time of death of a testator’s death and the Conservative Party is supportive of the fact that the members acknowledge a "child in gestation" is in fact a person able to recover a share of the estate. #13 S. 8441 Skelos – A. 12012 Rules The Conservative Party has long supported the fullest prosecution of criminals by extending indefinitely the time to commence a criminal prosecution for the crimes of rape, criminal sexual acts, aggravated sexual abuse in the first degree. #14 S. 8446 Skelos – A. 11951 Rules The Conservative has long supported the use of DNA evidence and supports this bill that expands the list of criminal convictions which require a person to give a DNA sample for inclusion in the state DNA database. #15 S. 8467 Golden – A. 12042 Rules The Conservative Party is a strong supporter of Second Amendment Rights but also strongly supports all legislation that seeks to remove illegal guns from our streets. #16 A

be strongly opposed to the use of tax #17 A 2517 DiNapoli – S 1290 LaValle This bill seeks to expand the returnable beverage container bill by including almost all bottles and also seeks to place all unclaimed monies into the Environmental Protection Fund. The Conservative Party is opposed to all new taxes and simply put this is another tax and will severely strain the retail stores forced to accept the returns and possibly create health problems with the extra bottles required to be collected. #18 A. 2673 Glick (No same as) The Conservative Party is opposed to this bill that seeks to expand the Family and Medical Leave Act to include domestic partners in any business with more than fifty people. We agree that families should be able to care of sick members, but not that the business be required to expend an already costly benefit, to those not legally recognized as families. #19 A 4111 Espaillat (No same as) This bill would require hospitals to provide language assistance services to patients, including vision and hearing impaired patients, in all aspects of hospital care, including, but not limited to health care, billing and making appointments. This bill, if enacted, would cause the cost of hospital care to further escalate and more importantly leave them open to lawsuits if such services were not available, therefore the Conservative Party opposes this bill. #20 A. 5406 Gottfried (No same as) The bill seeks to establish procedures for making health care decisions on behalf of patients unable to decide about treatment for themselves. Prior to the “B” amendment which offered protection for pregnant patients, we supported the concept of this bill. However, without the protection of pregnant patients, we can not support this bill. #21 A. 6300 Silver (No same as) The stated objective of this bill is “to promote the development of life-saving and life-enhancing regenerative medical treatments, therapies and cures by providing financial and other support for stem sell research and activities related to regenerative medicine. While no one would dispute the fact that the stated purpose of this bill sounds altruistic, the Conservative Party can not support the destruction of human embryos in the name of saving lives. We support adult stem cell and umbilical cord blood research which has proven to be a positive way to help humanity. #22 A. 6619 Gottfried – S. 5121 Spano The Conservative Party is opposed to this bill, known as the “healthy teens act” which seeks to prevent unwanted pregnancies and occurrences of sexually transmitted diseases among youth. While the proposal appears to be well intentioned, the bill fails to stress the need for abstinence and would cost $20 million. The Conservative Party believes that the cost of this grant would be better spent on real education needs; sex education classes have accomplished little in the past. #23 A. 9491 O’Donnell – S. 1454 Duane The Conservative Party believes every child should be free of harassment and discrimination and if another student, or group of students, continues to harass, bully or discriminate against another student, then that student or group of students, should be removed from the school immediately. This bill only addresses the bullying, harassment and discrimination that takes place with regard to sexual orientation, gender or sex and does not seek to protect all children. CPNYS seeks to protect all children and therefore opposes this bill. #24 A. 9906 Paulin – S. 6686 Spano This bill would authorize nurses and pharmacists to dispense emergency contraception without a doctor’s prescription to anyone regardless of age. The Conservative Party is strongly opposed to the legislation which will further endanger women by allowing them to take a drug still being studied by the FDA as well as the probability of increasing sexually transmitted diseases. #25 Rules Report # 559 to Amend a Budget Bill - Seminerio If adopted, this would have eliminated Medicaid funds for abortions. Bills 1 - 15 passed both houses; Bills 16 -25 passed the Assembly only EX = Member excused; ABS - Absent; NM - Not a member when vote taken; MS - in Military Service when vote taken.
